Statement of Stella James – 21.11.2013

On the 12th of November 2013, the Chief Justice of India set up a three-member Committee to look into a matter of sexual harassment that I had faced by a former Supreme Court Judge.

As requested by the Committee, I appeared before them on the 18th of November. During the meeting, I presented all the details of the case to the Committee. I am confident that the Committee will follow all the different lines of enquiry, and will establish the truth of my statements.

The Committee has assured me complete confidentiality. Some media reports are violating the confidentiality of testimony given by the Committee. They have been distorting facts, and misreporting my statements. Such pernicious and mala fide reporting must cease immediately. I would like to request the media to stop speculating on my communications with the Committee, and continue to respect my privacy.

  1. VIOLATING THE CONFIDENTIALETY REGARDING THE TESTIMONY GIVEN BY THE WITNESS
    BEFORE THE COMMITTEE APPOINTED BY THE HON: CHIEF JUSTICE OF INDIA CANNOT BE IGNORED.
    THE MEDIA HAS TO BE CAREFULL WHILE REPORTING THE MATTER AND STOP SPECULATING ON THIS SEXUAL HARASSMENT LITIGATION .

    1. —–A Humanitarian Appeal—–

      I am a Law Researcher. I am also a Human Rights activist and Social Worker. With due respect I hereby draw your kind attention to a very serious matter as the following.

      The government of India has been enacting peculiar and peculiar laws which are often in contradiction with the natural justice. Many such laws are also contradictory with the existing laws and the legal system of the country. Such laws are also unknown to any other country of the world. Please find below a list of such inhumanitarian and irrational laws.

      1. Section 498A of Indian Penal Code (arrest of entire husband-family, without bail)
      2. Domestic Violence Act 2005 (against male in-laws with maintenance and residence)
      3. Section 125 of Cr PC (endless maintenance)
      (Wife may lodge all the 3 cases simultaneously.)
      4. If divorced, wife will claim half of your property (besides monthly maintenance and separate residence).
      5. Monthly salary to wife Act (proposed)

      Under section 498A the police arrest the entire family of husband without any cognizable or visible evidence of crime.

      Conjugal (husband-wife) dispute is regarded civil jurisdiction across the world. In no other civilized country of the world the state authority has converted familial (civil) disputes into cognizable crime and subject to police action. Such a law is result of irresponsible legislation of the state authority.

      Even Folk Laws of Tribal Communities or Muslim Shariyat Law (with due respect) is far better than the modern secular law of India.

  2. Theif will always help a thief. Chief Justice of India Shivam reputation is well known , and how can he put Ganguly in jail when both use to have whisky together.

  3. What is Immoral is also Sin-

    People often indulge in immoral acts even against their moral will. They often do so out of ignorance. Specially, people in occupations like police, advocates, doctors or even judges are found doing immoral acts out of ignorance. They think that their acts are justified since they do it in pursuance of their occupation. So they have no responsibility even if it goes against their moral will. But this idea is wrong. Let me suggest you that you do abstein from doing immoral acts in the interest of your occupation. Because what is immoral is also sin. Do not compromise your moral values in the interest of your occupation.

  5. Did Supreme Court had Jurisdiction to constitute three sitting judge Committee when the retired Judge was not on their rolls and investigation required lodging of FIR at the relevant Police Station? Which Law allowed them to do so? If they had Jurisdriction,why they lamented for holding such an Inquiry and then to say that they would never hold such an Inquiry again, ever in future? Why did they disclose the name of the Rtd Judge but withheld the name of the woman? The damage to reputation of the Judge is incalculable despite the woman stating ‘had no desire to put his life’s work and reputation in question’-who is responsible for it.
